TERMS AND CONDITIONS

Exemption from legal responsibility

The clarifications and information provided on this page have only the general and unspecific purpose of how to write your own Terms and Conditions documents. You should not rely on this article as legal guidance or as recommendations on what you should actually do, as we cannot know in advance what are the specific terms you wish to stipulate between your company and your customers and visitors. We recommend that you seek legal advice if you need help to understand and create your own Terms and Conditions.

Terms and Conditions - Fundamental notions

That said, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you as owner of this website. T&C sets the legal framework that governs the activities of visitors to the website, or its clients, during their visit or interaction with this site. The intention of the T&C is to establish the legal relationship between the visitors of the site and you, the owner of the website.

The T&C should be established according to the specific needs and nature of each website. For example, a website that offers products to customers involving ecommerce transactions needs to have T&C that are different from the T&C of a website that offers only information (such as a blog, a forwarding home page to others, and so on).

T&C gives you, as the owner of the site, the possibility to protect yourself against possible legal exposures. However, this may differ from jurisdiction to jurisdiction, so seek local legal advice if it is intended to protect yourself from legal exposure.

What to include in the T&C document

In general terms, T&C usually regulate the following issues: who may use the site; possible payment methods; a statement that the owner of the site may change their offers in the future; the types of warranty that the owner of the site gives to their clients; a reference to intellectual property or copyright issues, where relevant; the right of the site owner to suspend or cancel a member’s account; and much more.
